1. Provider
This agreement is between you and Dante Langdon, doing business as Stonefern Works (“Stonefern Works,” “Stonefern,” “we,” “us,” or “our”).
2. Acceptance and legal capacity
By installing, launching, or affirmatively accepting this EULA where presented, you agree to these terms. If you are using software for an organization, you represent that you are authorized to accept these terms for that organization. If you do not agree, do not install or use the software.
3. License grant
Subject to these terms and any product-specific terms, Stonefern grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the software for lawful purposes on systems you own, control, or are authorized to manage.
5. Restrictions
Except to the extent a restriction is prohibited by applicable law or an applicable open-source license, you may not: (a) redistribute or resell Stonefern software without authorization; (b) remove proprietary notices; (c) use the software to gain unauthorized access, impair systems, distribute malware, violate law, or infringe third-party rights; (d) misrepresent Stonefern software as your own; or (e) use the software to defeat DRM, encryption, access controls, or copy protection unlawfully.
Nothing in this EULA limits rights you may have under a third-party open-source license included with a component.
6. Ownership
Stonefern and its licensors retain all right, title, and interest in Stonefern software and original documentation, excluding third-party components and user-owned data. The software is licensed, not sold.
7. Your data and backups
You retain ownership of your files and data. Some products can change files, network settings, Windows components, or input behavior. You are responsible for reviewing actions and maintaining appropriate backups before using functions that can alter important data or system state.
8. Updates and support
Stonefern may provide updates, fixes, or new versions. We do not promise that any particular version, update service, or support channel will remain available indefinitely. A new version may be subject to updated terms presented before or with that release.
9. Beta, preview, and experimental software
Software labeled beta, preview, experimental, or in development may contain defects, incomplete features, compatibility problems, or breaking changes. Use such releases with additional caution, especially on important systems or irreplaceable data.
10. Third-party software
Stonefern products may include or rely on third-party software. Those components remain subject to their own license terms. Where a third-party license grants you rights that conflict with this EULA, that third-party license controls for the component it covers.
11. Privacy
Stonefern’s processing of personal information is described in the Privacy Policy and applicable product notices. Local information is not received by Stonefern merely because a Stonefern product reads or stores it on your device.
12. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE.” STONEFERN DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT THOSE WARRANTIES MAY LAWFULLY BE DISCLAIMED. STONEFERN DOES NOT WARRANT THAT SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, COMPATIBLE WITH EVERY SYSTEM, OR ABLE TO REPAIR, RECOVER, CLEAN, OR PROTECT EVERY DEVICE OR FILE.
Nothing in this section excludes warranties or consumer rights that cannot lawfully be waived.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STONEFERN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOST BUSINESS, OR SERVICE INTERRUPTION ARISING FROM THE SOFTWARE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, STONEFERN’S AGGREGATE LIABILITY FOR A FREE PRODUCT WILL NOT EXCEED US$25, AND FOR A PAID PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not apply where prohibited by law or to liability that cannot legally be limited.
14. Termination
This license ends if you materially violate these terms. On termination, stop using and uninstall the affected software, except that terms which by their nature should survive—such as ownership, disclaimers, liability limits, and third-party license rights—remain effective.
15. Governing law
To the extent permitted by applicable law, these terms are governed by the laws of the State of Connecticut, United States, without regard to conflict-of-laws rules. Mandatory consumer protections of your jurisdiction remain unaffected where they cannot be waived.
16. Changes to this EULA
Stonefern may update this EULA for future releases. The effective date and version will change when material terms change. Continued use of a release after legally effective notice may be subject to the updated terms where permitted by law.
